Terms of Service

1. Acceptance of Terms

By accessing or using PocketNote ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all visitors, users, and anyone who accesses or uses PocketNote at pocketnote.app or through our iOS app.

2. Eligibility

To use PocketNote, you must:

  • Be at least 14 years of age.
  • Create an account using a valid email address, or by signing in with Google or Apple.
  • Have access to the internet.

By using PocketNote, you confirm that you meet these requirements.

3. Account Registration

You can register with an email address and password, or sign in with Google or Apple. If you sign in with Google or Apple, you grant PocketNote access to your account email address and display name. You are responsible for maintaining the security of your login credentials and for all activity that occurs under your PocketNote account.

You agree to notify us immediately at hello@pocketnote.app if you become aware of any unauthorized use of your account.

4. Description of Service

PocketNote is an AI-powered study companion designed to help students learn more effectively. The Service allows you to upload study notes, documents, audio, and links, which are then used to generate:

  • Interactive quizzes
  • Flashcards with spaced repetition
  • AI-narrated podcasts
  • Mind maps for concept visualization
  • Slide decks and study tables
  • Study reports and summaries

The Service also includes an AI chat assistant that answers questions grounded in your uploaded materials, with a choice of AI models, and optional connectors that let the assistant work with your third-party accounts (see Section 6).

5. AI Models and AI-Generated Content

PocketNote offers a selection of third-party AI models (such as Google Gemini, OpenAI GPT, Anthropic Claude, DeepSeek, and xAI Grok), accessed through an AI gateway as described in our Privacy Policy. The set of available models, and which models are included in each plan, may change as providers update, deprecate, or reprice their models. We may substitute a model of comparable capability when a provider discontinues one.

The quizzes, flashcards, summaries, and other study resources generated by PocketNote are created by AI based on your uploaded materials. AI-generated content may contain errors or inaccuracies. You should verify important information against your original sources. AI-generated study materials are provided for personal educational use and should not be treated as authoritative academic or professional sources.

6. Connectors and Third-Party Accounts

PocketNote optionally integrates with third-party services you choose to connect, such as Google Drive, Gmail, Google Calendar, Notion, Outlook, Outlook Calendar, OneDrive, and Dropbox. Connectors are optional; the Service works without them.

  • You authorize each connector individually through the provider's consent screen, and you can view and disconnect your connectors at any time from Settings.
  • Some connectors provide deliberately limited access: the Google Drive connector can only access the specific files you select via the Google file picker (it cannot browse the rest of your Drive), and the Gmail connector can only send emails you explicitly compose and confirm (it cannot read, search, or access your inbox or existing messages).
  • You are solely responsible for the third-party accounts you connect: for having the right to connect them, for the content you import from them, and for actions you instruct the assistant to take with them (such as sending an email).
  • Actions performed through connectors at your direction are treated as your own actions.
  • Your use of a connected third-party service remains subject to that service's own terms, and we are not responsible for third-party services, their availability, or changes to their APIs that may limit connector functionality.

7. Acceptable Use

You agree to use PocketNote only for lawful purposes and in accordance with these Terms. You must not use the Service to:

  • Upload or process content that is illegal, harmful, or violates any applicable law.
  • Infringe the intellectual property rights of others.
  • Attempt to reverse-engineer, scrape, or extract data from the platform.
  • Abuse the AI systems, circumvent usage limits, or resell access to the Service.
  • Use connectors to send spam or unauthorized messages, or to access accounts you do not own or control.
  • Upload content containing malware, viruses, or other malicious code.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Use the Service for commercial purposes without our prior written consent.

Violation of these rules may result in immediate account termination without refund.

8. Your Content

You retain full ownership of any notes, documents, or other materials you upload to PocketNote. By uploading content, you grant PocketNote a limited, non-exclusive license to process and store that content for the purpose of providing the Service to you. We do not use your content to train AI models.

You are responsible for ensuring you have the right to upload and process any content you submit, including content imported through connectors. PocketNote does not claim ownership over your study materials.

9. Plans, Credits, and Fair Use

AI features consume credits, which are included with your plan and may be replenished daily. Free accounts have limited credits and feature caps (for example, a limited number of notebooks and connectors, and lightweight AI models only). Paid plans include larger credit allowances and access to additional models and features.

Credit amounts, plan limits, and the credit cost of individual features may be adjusted over time to reflect underlying AI provider pricing. We also apply reasonable technical rate limits to keep the Service reliable for everyone.

10. Payment and Billing

Access to certain features of PocketNote requires a paid subscription. Payments on the web are processed securely through Stripe; purchases in the iOS app are billed by Apple through the App Store. Subscription fees are billed on a recurring basis (monthly or annually, depending on the plan you select) and are non-refundable except as described in our Refund Policy below.

You authorize recurring charges to your payment method until you cancel your subscription. You may cancel at any time — from your account settings on the web, or through your App Store subscription settings for purchases made on iOS. Cancellation stops future charges; you keep access until the end of the paid period.

11. Refund Policy

We offer a full refund within 7 days of your initial purchase, provided you have not actively used the Service (for example, uploaded documents or generated study materials) during that period. To request a refund, contact us at hello@pocketnote.app within 7 days of purchase. Purchases made through the App Store are refunded by Apple under Apple's refund process.

Refunds will not be issued for partial subscription periods or for accounts terminated due to a violation of these Terms.

12. Account Deletion and Termination

You may delete your account at any time from Settings → Delete Account. Deletion is immediate, permanent, and irreversible: your notebooks, uploads, chats, generated materials, and connector tokens are removed and cannot be recovered. Deleting your account does not by itself cancel an active App Store subscription — manage that through your Apple ID settings.

We may suspend or terminate accounts that violate these Terms. Where reasonable, we will notify you and give you an opportunity to export your content, except in cases of serious abuse.

13. Service Availability

We aim to keep PocketNote available at all times, but we do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, upgrades, third-party provider outages, or events beyond our control. We are not liable for any loss or inconvenience caused by service interruptions.

14. Intellectual Property

All rights in the PocketNote platform, including the interface, design, codebase, and branding, are owned by or licensed to PocketNote. Nothing in these Terms grants you any right to use our intellectual property beyond what is necessary to use the Service as intended.

15. Limitation of Liability

PocketNote is provided "as is" without warranties of any kind, either express or implied. To the fullest extent permitted by law, PocketNote shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid to PocketNote in the 12 months preceding the claim.

16. Amendments

We may update these Terms of Service from time to time. When we make material changes, we will notify you via email or a prominent notice on the platform. Continued use of PocketNote after changes take effect constitutes your acceptance of the revised Terms.
